Volunteer Waiver and Release
1. I understand, acknowledge, and am fully aware that there are inherent risks (physical and otherwise) involved in volunteering for and including but not necessarily limited to the DICK’S Sporting Goods Pittsburgh Marathon, and/or any of the related events (individually, “Event”, and collectively executors, administrators, representatives, and assigns, with the intent to be legally bound, hereby waive and release any and all claims, actions, suits, or demands that may arise as a result of my volunteering or providing other services for any of the Events, or in any way connected with my participation in the Events, including but not limited to claims for negligence, premises liability, illness, personal injury (including death), emotional injury, tort injury (whether intentional or otherwise), property damage, or any other claim of any nature whatsoever, that I have or may have as a result of or in connection with my participation as a volunteer for the Event(s). I further attest and certify that I am physically capable of performing the tasks required for the volunteer job(s) I have selected and would not attend the event if feeling sick/under the weather. I acknowledge that I am aware that I need strong customer service skills and am I able to read, write and communicate clearly, since all volunteer positions work directly with the public, staff, and other volunteers. This Waiver and Release is for the benefit of, and applies to, Pittsburgh Three Rivers Marathon, Inc. (“P3R”), any sponsor of the Event(s), or any of their respective employees, officers, directors, shareholders, predecessors, successors, assigns, or representatives.
I further agree to hold P3R and any sponsor of the Event(s), harmless for any damage or costs (including reasonable attorneys’ fees) resulting from any and all claims or demands made against them as a result of my negligent or intentional acts, or failure to act, in connection with my volunteering for any of the Events.
2. I hereby grant permission to the Pittsburgh Three Rivers Marathon, Inc (“P3R”) and its sponsors to use, for all legitimate purposes, any photographs, motion pictures, recordings, or any other record in any form, in which an image or record of me or my voice may be included, which image or record was taken or recorded before, during, or after, or as otherwise associated with including but not necessarily limited to the DICK’S Sporting Goods Pittsburgh Marathon, and/or any of the related events (individually, “Event”, and collectively the “Events”).
Fair Credit Reporting Act Disclosure Release
Pittsburgh Three Rivers Marathon, Inc., (“P3R”) may request a consumer report and/or investigative consumer report, as defined by the federal Fair Credit Reporting Act, on you from a consumer reporting agency in connection with your volunteering application and for volunteering purposes. A consumer report is a compilation of information that might affect your ability to volunteer for the Company. These reports may contain information about your character, general reputation, personal characteristics and mode of living. They may involve personal interviews with sources such as your neighbors, friends or associates. The reports may also contain information about you relating to your criminal history, credit history, driving and/or motor vehicle records, education or employment history, or other background checks. You have the right, upon written request made within a reasonable time after the receipt of this notice, to request disclosure of the nature and scope of any investigative consumer report prepared. You consent to P3R obtaining such a report or reports.
